Terms of Use

1. Parties and Acceptance

This Terms of Use Agreement ("Agreement") is entered into between UĞUR ÇELİK 7BİTBİTES E TİCARET VE YAZILIM ("Service Provider"), the owner and operator of the "Cardely" application ("Platform"), and any person who becomes a member of the Platform or uses the Platform ("User").

By becoming a member of the Platform or using it, the User acknowledges that they have read, understood, and fully accept all the terms contained in this Agreement.

2. Platform Purpose and Host Provider Status

2.1. Cardely is a technology infrastructure that enables users to create study cards (flashcards) and decks by entering text or uploading PDF files for processing via artificial intelligence, to share these decks among themselves, and to facilitate their study activities.

2.2. The Service Provider holds the status of "Host Provider" as defined by Turkish Law No. 5651 concerning the Regulation of Publications on the Internet and the Combating of Crimes Committed Through These Publications. The Platform has no obligation to pre-screen or investigate the legality of content created, uploaded, or shared by users (texts, uploaded PDF files, and created decks).

3. Content Responsibility and Intellectual Property

3.1. All legal, criminal, and copyright responsibility for texts entered by users into the Platform, PDF documents uploaded, and decks created is the sole responsibility of the User.

3.2. The User acknowledges and warrants that they are the legal owner of PDF files and texts they upload to the Platform or request to be processed via artificial intelligence, or that they have obtained the necessary copyright and usage permissions from the relevant work owners. In case of infringement of third-party copyrights, the Service Provider accepts no responsibility. All legal consequences and compensation claims will be referred to the User.

3.3. The User retains ownership of the content they create. However, when the User sets their content as "Public" (searchable), they grant the Service Provider a royalty-free and continuous license to host, display, process with artificial intelligence algorithms, and present this content to other users on the Platform.

3.4. The Cardely application's code, interface, artificial intelligence algorithms, and all visual/technical designs are the property of the Service Provider and may not be copied or used without permission.

4. Notice-and-Takedown Mechanism and Copyright Infringement

Rights holders who believe that any deck or content shared on the Platform infringes upon their personal or institutional copyrights may report the infringement by providing the deck name and documentation proving their ownership to iletisim@cardely.app.

Such notices will be reviewed within applicable legal timeframes, and content found to constitute infringement will be removed from the system.

5. Inaccurate Information and Artificial Intelligence Disclaimer

5.1. Decks within the Platform are created entirely by Users or by artificial intelligence based on PDFs uploaded by Users. The Service Provider makes no guarantee regarding the accuracy, currency, scientific validity, or completeness of the information contained in these cards.

5.2. The process of creating cards from PDFs using artificial intelligence (AI parsing/generation) is an experimental technology and may produce incomplete, erroneous, or illogical results. It is the User's responsibility to verify the output.

5.3. The Service Provider is not responsible for any exam failures, professional errors, or any material or non-material damages that Users may incur as a result of studying with incorrect, incomplete, or outdated information in these decks.

6. Data Loss and Technical Interruptions

6.1. The Service Provider does not guarantee that the Platform will operate without interruption or error. Service interruptions may occur due to maintenance work, infrastructure issues, cyber attacks, or server-related problems.

6.2. Decks created by Users, PDF files they upload, or study statistics may be deleted or lost due to server or database errors. The Service Provider does not provide permanent data storage (backup) guarantees. In case of data loss, Users cannot claim any compensation, rights, or refunds from the Service Provider. Users are responsible for backing up their own content physically or in other locations.

7. Governing Law and Jurisdiction

Any disputes arising from the application or interpretation of this Agreement shall be governed by Turkish law. The courts and enforcement offices of Erzincan shall have jurisdiction over any disputes related to this Agreement.
